Overview of class

This course introduces mediation from the perspectives of both the mediator and the attorney representing a client. Students will build a theoretical foundation in mediation and mediation advocacy while gaining hands-on experience through simulations, feedback, and observation of a mediation in the Cook County courts. A central component of the course is a professional mediation skills training conducted by the Center for Conflict Resolution (CCR). Some training sessions take place on weekends. All students must attend a mandatory training on Sunday, September 27. Students seeking eligibility for the Spring Mediation Practicum will complete additional training on Saturday and Sunday, October 3-4.

Registration Requirements

Negotiation, LITARB 670 or 670K or Cultural Negotiation LITARB 674 are a co-requisite for this course. Students concurrently bidding to be enrolled in Negotiations may bid on this course.

Learning Objectives

By the end of the semester, students will be able to: Improve their skills in listening, questioning, and problem solving; Translate positions to interests; Distinguish major mediation models; Describe the benefits and pitfalls of in-person and online mediation; Identify effective mediator behaviors in the facilitative mediation model; Analyze advocacy skills to determine impact on mediation outcome; Promote appropriate use of mediation to potential users of mediation; Recognize areas for improvement in the field of mediation; Demonstrate creativity and innovation through problem-solving skills

Evaluation Method

Class Participation Exercises and Reflections (25%), Mediation Representation Plan & Attorney/Client Opening Statement (20%), Group Presentation (25%), Final Project and Paper (15%), Mediation Observation (15%)
