Learning Objectives
By the end of this course, students will:
1. Understand the elements of and defenses to a range of unique business/economic torts;
2. Evaluate the strength of business torts claims and defenses and develop arguments in relation to them; and
3. Anticipate potential liability issues and advise enterprises on how best to avoid litigation and offset risk specific to their enterprise goals.
Evaluation Method
There will be three evaluation items: two essays on assigned topics and a 1.5 hour final exam.
The essays will have a page limit, be administered through Canvas, and will be evaluated anonymously as I would if they were exam questions.
The essays will be completely different in topic, scope, and prompt and therefore comments on the first would be irrelevant to preparation for the second. As such, there will be no interim, individual assessment of the essays.
The 1.5 hr final exam will be self-scheduled.
The final exam will be 45% of your grade; the essays will each be 20%, and my assessment of the quality of your course engagement will count for 15%.
