Overview of class
In the context of "big ticket" commercial litigation, we discuss how to develop your case, how to pick a theme and tell a story. We discuss the strategy of discovery, the strategy of settlements, how to manage the risks of a big case, how to use experts and jury consultants to benefit your client, how to be effective in mediation, and how to be effective with clients. We also get the perspective of (i) three current federal judges on what they see as effective advocacy and (ii) a general counsel of a huge company. The emphasis is on the real-world aspects of major commercial cases.
Learning Objectives
Students will have a better understanding and appreciation for the practical aspects of how to manage and handle big ticket commercial litigation.
Evaluation Method
45% take home exam, 30% participation and 25% attendance.
